When i went on a Bikesafe day, the copper reckoned that if you are filtering at over 30 mph, they are likely to deem it as undertaking.

There, legally, is no offence of undertaking.

No but he said he would prosecute as careless or dangerous riding depending on his view at the time.

Yes thEy can do that, however IF THERE IS A MIDDLE LANE HOGger then if you maintain your speed and do not change lanes then it can not be considered careless or dangerous driving. That only comes into play if you start swapping lanes to pass on the left.

I think its much down to the individual copper as anything else.

Whatever arguments we may use they do have the option to prosecute as you can only filter when the traffic is considered to be queuing.

Filtering - How it differs from an 'Overtake'.

Contrary to the belief of some motorists, filtering is entirely legal in the UK, providing that it is done safely. Once traffic speeds are high enough to suggest that the traffic is no longer queuing, your manoeuvre may then be regarded as a dangerous overtake.

Agreed, I wasn't talking about filtering though, more occupying a full lane.

That was taken from a solicitors website who specialises in motoring offences.
