Yes thEy can do that, however IF THERE IS A MIDDLE LANE HOGger then if you maintain your speed and do not change lanes then it can not be considered careless or dangerous driving. That only comes into play if you start swapping lanes to pass on the left.
I think its much down to the individual copper as anything else.
Whatever arguments we may use they do have the option to prosecute as you can only filter when the traffic is considered to be queuing.
