The update.

Had the forks done at P&H yesterday, took a while, yet have to say great service manager, had a look around the showroom (another update for that story 8) ), read some bike magazines, fell asleep on the couch for an hour then was told:
- the forks have been out at some point (in an inquiring kind of bad way)
- one of the forks had 100mm of oil MISSING!
- its been tested and all good now
- head race bearings all checked to right torque settings (don't know if they checked the actual bearings though)

Off i go, stop at the junction, "clunk", what, no wait, that'll be the pads bedding in, off up the motorways home as had something i need to get back to. stop outside my garage 'clunk', hmm that doesn't sound right. put on the brakes and push the suspension up and down, 'clunk, clunk, clunk' WTF!!!! a different kind of noise to the bag of spanners the forks felt like, yet none the less a 'clunk'.

I called P&H and they said all was OK, they can make some noises, and if the 'clunk' was out of the norm their guy would've noticed as he's a qualified Ohlins guy. even so they said pop back in and they'll go over it again for me no charge. i'll do that friday maybe on the way to a client meeting as its 40 miles out of my way!

Now my buddy JT and i checked the break callipers, pads (didn't check the sizes or get them out so will do that today as they could be wrong) the discs and all seemed OK.

i'm going to get the misses to video what I'm doing to send off to Jordan bikes; i know Kwackers are awesome bikes, yet clearly not this one. i've had enough now, i want rid, i'm sure its nothing serious yet after 3 months ownership and not really being able to ride it I'm done now. shame its a great bike, awesome engine, that QS i fitted is sublime and it handles like a 600 yet i've unfortunately grown to hate it.

I've emailed Jordans, updated them (they called me straight away yet i was out so couldn't talk, will do Tuesday) and have started to say i want rid of it, they've been ever so helpful in getting the broken fairing parts to me to fit and the forks issue so i can't fault that, it's a one off and just unlucky i guess. i'd still buy from them if they do me right. they're getting in a BWM R nine T which has been on my bucket list so may see what they can do on that for me. we shall see.

Like iu say just bad luck, i did want to keep the bike, yet not now.

There's nothing worse than having no faith in a bike. Sadly it sounds like it's time to get rid.

Yeah it's a pain. I like the bike and would've kept it. Yet now it's going to be a balance of keeping level headed whilst trying to get either a full refund or a good price on another one from Jordan's. Like I say they've been really professional about it all. They could've said get lost we don't know you and you're taking the piss. Yet as you all know of me I buy quite a few bikes and don't muck about instead care for and look after my bikes.

At the end of the day my BMW local dealer will look after me as I've bought from them before yet even they said they'd not give more than £6.5k max. for mine (maybe work something at their end on a bike).

I'm not willing nor should I loose £1.3k on trading in so ideally I'd want a full refund or what is likely to happen is they sort me a good price on the R nine T they've got coming in. Thanks for the link to the consumers act 2015 info by the way. I've read it through and I'd say I've got a good position of negotiation to talk from.

Saying that I'd really like to buy from my local BMW dealer as they're around the corner of anything is wrong.

I'm speaking with Jordan's tomorrow so we'll see. I may even send them a link to this thread so they can see I'm above board if things get shitty .

An update.

So i've spoken with Nick at Jordan's, it cost them £560 to get the forks done at P&H!!!! I was told to take it there as it would only be around £200 by his partner Nicky instead of going to my local chap for £450, all to save me sending back up to them. if i'd know a) the parts were going to be 4 weeks and b) it was going to cost them £560 i'd have insisted it went back up to them as per their warranty it states they do the work. Yet they were kind enough to get it sorted for me down in Surrey, which i acknowledged.

He's not willing to give me a full refund (hey i have put 900 miles on the bike as P&H said it wasn't a safety issue so i could ride it), due to the fork issue costs, which i understand re warranty T&Cs etc. so i was expecting it less the fork costs, yet he offered me £900 less, i said i would think about it.

So i called my local BMW chap (clearly happy i was thinking of buying another bike with them again 8) ) and he did an HPI, it turns out it is a JBF 2010 model, yet registered in 2012. Here's the kicker, now worth on trade £2.9k below what i paid!!!!

Now, no where on the advert (i recall) or during my discussions was this mentioned to me by the sales person, i wouldn't have bought it at that price as there were other 2010's out there for £1-1.5k less. i know they can sell it for whatever they want, yet not advertise it as a different year model.

I'm happy (well not really yet know their T&Cs so i can't contest it) to write off the £560 fork costs, yet i want the full difference back.

I've not sent the email yet, I've stayed professional and non-emotive in my response, yet what do you think, so i:
- quote the Consumer Right Act of 2015 and go for the full refund as i was never told it was a 2010 model
- quote the act yet say i'll expect an offer less the £560 costs
- take his offer and run and loose £900

Interesting start to the day eh...

In brief:

Return fire rejecting their offer, don't quote the Act but make it clear you know your rights, highlight the problems and the 2010/2012 issue making it clear you didn't want a 2010 bike, ask for a full refund.

If you're happy with taking a slight hit then have that as your settlement position, but don't open on that basis.

Guys, some confidential info. on this email, yet considering you nice folk are always so helpful, anyone from a legal background able to comment if i'm within my rights re the below letter to Jordan's?

Like i say up to today they've been very helpful (Nicky in parts and Nick sorting the fork work) so i'm not slagging them off at all, yet for whatever reason the bike was sold to me as:
- a 2012 not 2010 model
- fairing brackets broken under the tank and now marked the frame
- fork internals shagged!

I've not plastered this over social media, FB or twitter etc. just discussing with you guys on here, as i'd like to be cool and just get my monies back.

He then asked me to ‘sit down’ and said trade in value is now £5,025.00 trade in from Glasses guide!!! So if I traded it in with them I’d be £2,875.00 out of pocket.

I know Mike never mentioned it was a 2010 model when I was buying it, I wouldn’t have bought at that price. There were 2010 models available £1k or more less, yet I wanted the latest/newest model I could afford hence going for your 2012 bike.

I appreciate the cost of the forks debacle and it being done and the broken brackets being replaced, yet, this is a whole new situation and I now feel I have been miss-sold to being blunt, going by the Consumer Right Act of 2015 descriptions.

I would request you raise your offer considering this new information coming to light Nick.

I’m trying to maintain the friendly and professional approach we both have had throughout, and willing to meet half-way on the fork repair costs.

I look forward to hearing back from you Nick on this one, and hope we can get it sorted so I can arrange for the bike to be collected and sent back to you at my cost ASAP now.

As you are aware, since buying the bike I have had very little opportunity to use it due to various faults with it, which, unbeknown to myself, were present at the time of purchase. You have very kindly cooperated with the attempts made to rectify those issues.

Recently I contacted a local BMW dealer to discuss with them trading in the ZX10R against a standard BMW R nine T. As part of those negotiations They HPI’d the ZX-10R (see attached photo). As you can see from the HPI search result, the ZX10r is a JBF which is a 2010 model. I purchased the bike from you based on your representation that the ZX10R was a 2012 model. The price I was prepared to pay reflected that representation.

The BMW sales representative offered me a £5,025.00 trade in based on the approved Glasses guide!!! So if I traded it in with them I’d be £2,875.00 out of pocket.

I know Mike never mentioned it was a 2010 model when I was buying it, I wouldn’t have bought at that price. There were 2010 models available £1k or more less, yet I wanted the latest/newest model I could afford hence going for your 2012 bike.

Gents, the VIN is xxxxxxxGJJA005263, (the x's are more numbers) and checking the site this is a 2010 model, yet cant find a specific Kwacker site to check them on. am i right on this being a 2010 and not a 2011?

either way it was advertised as a 2012, yet want to get my facts right before sending off the mail.
