There are some changes being rolled out tomorrow to limit the costs involved in these personal injury claims

Apply fixed costs in relation to medical reports obtained pursuant to, and offers to settle in respect of, low value soft tissue personal injury claims started under the Pre-Action Protocol for Low Value PI Claims in RTAs.

Discourage insurers from settling whiplash claims without a medical report confirming the claimant’s injury.

Prevent experts who produce medical reports from also offering treatment to the injured claimant to ensure there is no incentive for them to encourage unnecessary treatment.

All too easy to fake these whiplash claims by unscrupulous claimants....the flip side is that in many instances these sorts of injuries don't manifest themselves until several days after the incident.

The fixed costs I can see working, as long as it's fair recompense for time off work due to pain etc, but Iirc don't claimants have to sign a document about "full & final settlement"? Not good if the injury comes back to haunt you in later years.

As for the Reporting Specialist/ Treament Specialist regs, it'll just end up with two "Specialists" pairing up and tag teaming claimants surely?

Insurance companies were their own worst enemies in this by paying out for whiplash to avoid legal costs and it became the norm for them to payout with no questions asked.

It's not the norm, only a couple did it. It made commerical sense. £1000 to get rid of it or £5,000 to argue it?

Whiplash costs us around £80 each year on our premiums.

The Insurance companies weren't to blame for the government bringing in No Win No Fee.

Oddly enough I spoke to a girl the other day who had been in an accident and now has crippling back pain that only came on a year or so after. She had done the 'full and final settlement' claim but is still able to claim again as the damage could not have been foreseen. Apologies if that's a bit vague, it was a pub discussion!

When I smashed up my daytona, one of the cars I hit was driven by a girl at my own work. She asked me first if she was ok to claim injuries (nice of her) so I said yes. She then tells me later that after putting a claim in, my insurers rang her to say that if she gets a doctors note with the injury claim, she would get more money.


How odd?!!?!?!
