For as long as they want to. It is a condition of your insurance contract that you assist. If you don't then your insurer can pay out and look to recover the costs from you but they rarely do.

I'll tell my solicitors to issue in the new year.

The Police have just come back to me and said that they've not had a response to the NIP but it's only just been issued. I will get an update in early January.

So things are moving, just slowly.

I really hate all the process. Surely it's pretty clear what happened by the marks. Driver pulled into rider. Simple. I hate things hanging over my head unsure how they can have it all hang over theirs. W&*kers the lot of them

I realise you find my lack of knowledge of the legal system somewhat irksome Kwackers, but I'll fall for it anyway & point out that I thought a NIP had to be issued within 14 days.?
So it seems slightly strange (to an uneducated me anyway) that the Police claim they've only just issued it.??

Exceptions

There are some exceptions to the 14-day rule. For example, if the police could not have reasonably found the information to send the NIP to you within the 14-day period, it may still be possible to prosecute you.

This is also the case if you have moved without updating your registered address. Even if the NIP goes to your old address and you don’t receive it, this would probably be enough to prosecute you.

Also, there is some extra leeway if you didn’t own the car – for example, if it is a hired car, or you borrowed it. The NIP has to be sent to the registered “keeper” of the vehicle, so even if you were not aware of the NIP, it could be valid if the owner received it.

You will also not receive a NIP if you were involved in an accident – in this case, your knowledge that there was an accident is considered notification that an offence was committed. If you were not aware you were involved in an accident (for example, if you bumped a parked car without noticing) a NIP would be required.

No, it's my fault, I should be more careful with my wording.

The police haven't given me a date when the NIP was sent. Nor have they said if this is the only NIP. They may have sent one and then been told by the register keeper who the driver was.

There's also the response period to take into account as well.

So the police are progressing matters in accordance with the rules but there are steps to be taken and certain time periods to be observed.



Also bear in mind there is the possibility of a protection. So I'm not going to jeopardise that by putting too much information online. Which is what I do whenever I discuss a case I'm working on.

After a bit of stroppy lawyer mode action my repairs have been approved. I need to book the bike in and get it sorted.

what a ball ache - just what you dread. So, in future, full comp insurance and protected ncb? or did you have full comp?

I've had two incidents in the last two yrs, both with non UK drivers, luckily both were insured although one denied all guilt, fortunately for me even his own insurers didn't agree with him and paid out.

I'm fully comp. Even having protected NCB doesn't help as they still up your insurance policy as you've made a claim.

carole nash is top of line, i'm with peter james as they give discount to vjmc members, good prices but apart from being helpful/ 'can do' i haven't had to put them to the test yet.

More left hand/right hand stuff.

DMC have heard nothing from Aviva so they can't crack on with the repairs. So I've had to chase Carole Nash for a letter I can send to DMC. Once DMC have got that they'll order the parts and then we can book the bike in.

No update from the police, the person dealing with it is away until next week.

No update from my solicitor so I've had to chase him as well.

should have asked for a courtesy bike, at £90 odd quid a day I'm sure they would get yours suited a little quicker.

I think I'm being messed about because I didn't go with the recommended repairer from Carole Nash/Aviva. But I've heard conflicting stories about the quality of the work done by these approved garages. I prefer to wait longer and get the job done right.

I did the same with mine and sent the triumph to the main dealer but ironically had the opposite problem as my insurers were chasing the garage for the estimate to get the ball rolling. Took over a month from dropping the bike off to get the estimate through! so if its not one its the other mate!

After a couple more emails this morning we're back on track. DMC have now ordered the parts and will give me a shout when everything is in.

I'll order a new chain and sprocket as well. I might as well get that fitted while they've got the bike.

What a crap situation. Hope this gets resolved for you but im guessing its going to take some time no matter what the out come.

I've spoken with the Police. The plates were cloned. The driver can prove where she was and she had reported the cloned plates issue before the accident.

So as it's classed as an untraced driver I lose my no claims bonus.

Insurance and the insurance industry is so **** up at the moment.
